Terms of Service

The service

SetterStack is software that helps you respond to Instagram and Facebook messages and comments, qualify leads, run automations, and book calls. We may add, change, or remove features over time.

Your account

• You must provide accurate information and keep your credentials secure. You're responsible for activity under your account and your team members' accounts.
• You must be at least 18 and able to form a binding contract.
• You're responsible for the social accounts you connect and for having the right to connect them.

Acceptable use

You agree not to use SetterStack to:

• Send spam, or message people who have not opted in or contacted you.
• Violate Instagram/Facebook (Meta) platform rules, messaging-window limits, or any applicable law (including anti-spam, consumer-protection, and privacy laws).
• Deceive, harass, defraud, or harm anyone, or send unlawful, misleading, or abusive content.
• Scrape, mass-DM strangers, or use the service to build or feed a competing product.
• Interfere with, overload, or attempt to breach the security of the platform.

You are responsible for the content your account sends, including messages generated by the AI using the offer, claims, links, and instructions you configure. Keep them accurate and compliant.

Third-party platforms

SetterStack depends on Meta's platforms and other providers. We don't control their availability or policies, and we're not responsible if a platform restricts, suspends, or bans your account, changes its rules, or has an outage. Your use of those platforms is also governed by their terms.

AI features

SetterStack generates messages using AI based on the configuration you provide. AI output can be inaccurate or inappropriate— you are responsible for reviewing your setup, monitoring conversations, and the messages sent from your account. Don't rely on the AI for legal, medical, financial, or other professional advice, and keep a human in the loop for sensitive situations. You're responsible for disclosing AI use where your industry or jurisdiction requires it.

Plans, billing, trials & auto-renewal

• Paid plans are billed in advance on a recurring basis through our payment processor (Stripe).
• Subscriptions renew automatically at the end of each billing period at the then-current rate until you cancel. Trials, if offered, convert to paid unless cancelled before they end.
• You authorize us to charge your payment method for the plan you select and any usage-based amounts.
• Fees are non-refundable except where required by law. You can cancel anytime from Settings → Billing; you keep access through the end of the paid period.
• We may change pricing with reasonable notice; changes apply to your next billing cycle.

Your data

You retain ownership of your data and your leads' data. Our handling of it is described in the Privacy Policy and, where we process personal data on your behalf, the Data Processing Agreement. You grant us the limited rights needed to operate the service for you.

Suspension & termination

We may suspend or terminate accounts that violate these Terms, create legal or security risk, or fail to pay. You may stop using and delete your workspace at any time. Some provisions survive termination (e.g. payment owed, limitations of liability).

Disclaimers

The service is provided "as is" without warranties of any kind. We don't guarantee specific results (such as bookings or revenue), uninterrupted availability, or that automated replies will be error-free. You use the service at your own discretion and risk.

Limitation of liability

To the maximum extent permitted by law, SetterStack is not liable for indirect, incidental, or consequential damages, or for lost profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Indemnity

You'll defend and indemnify SetterStack against claims arising from your content, your use of the service, or your violation of these Terms or the law.

Governing law & disputes

These Terms are governed by the laws of the United States and the state in which SetterStack is organized, without regard to conflict-of-laws rules. You agree to first try to resolve any dispute informally by contacting us at info@setterstack.com before pursuing any formal action.
